1. Scope

These Terms of Service (TOS) apply to all orders placed via our online shop. By placing an order, you agree to these terms.

2. Contract Partners & Conclusion of Contract

The purchase contract is concluded with Nowhere Girls / nowheregirls.com. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. A binding contract is formed when we send you an order confirmation or deliver the goods.

3. Prices and Payment

All prices are final prices. Depending on your location, shipping costs or local taxes may apply. Payment is processed via our secure payment provider, Stripe.

4. Retention of Title

The goods delivered remain our property until full payment of the purchase price has been received. You are not permitted to pledge, transfer by way of security, process, or redesign the goods before transfer of ownership without our consent.

5. Customer Responsibilities

You are responsible for providing accurate and complete information during the checkout process (e.g., name, shipping address, and email). Any costs arising from incorrect delivery information provided by the customer shall be borne by the customer. You agree to use the website and our services only for lawful purposes.

6. Delivery and Shipping

Delivery times are estimates. Please note that for international orders, local customs duties or import taxes may apply and are the responsibility of the buyer.

7. Force Majeure

We shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control ("Force Majeure"), including but not limited to strikes, lockdowns, accidents, war, fire, natural disasters, or disruptions in energy or transport networks.

8. Right of Withdrawal

Consumers in the European Union have a statutory 14-day right of withdrawal. For details, please refer to our Returns & Refund Policy.

9. Warranty and Liability

The statutory warranty rights apply. We are liable for damages only in cases of intent or gross negligence. We take no responsibility for the continuous availability of the website.

10. Governing Law & Dispute Resolution

The laws of the country where our business is registered apply. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

11. Severability Clause

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent of the parties.
